Terms of Service

Welcome to CodeMart ("Company," "we," "us," or "our"). By accessing or using codemart.io (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

1. Overview

CodeMart is a marketplace that connects buyers and sellers of presale codes for concerts, festivals, sporting events, and other live events. We are not a ticket broker. We facilitate the sale of presale codes between independent sellers and buyers.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use CodeMart. By registering, you represent that all information you provide is accurate and that you are legally permitted to use this Platform in your jurisdiction.

3. Seller Obligations

• Sellers must list only presale codes they legitimately own and have the right to sell.
• Sellers must complete Payment Connect onboarding to receive payouts.
• Sellers must ensure codes are valid and functional at the time of sale.
• Sellers may not list codes that violate any event organizer's terms of service.
• Fraudulent listings will result in immediate account suspension and forfeiture of pending payouts.

4. Buyer Obligations

• Buyers are responsible for verifying that purchased codes work before the presale window closes.
• All sales are final once a presale code has been delivered. By completing a purchase, you acknowledge receipt of the code and agree that the transaction is complete.
• Disputes must be raised through CodeMart's dispute system before contacting your bank or card issuer. You agree to allow CodeMart a reasonable opportunity to investigate and resolve any issue before initiating a chargeback or payment reversal with your financial institution.
• Filing a chargeback without first opening a dispute through CodeMart is a material violation of these Terms. In such cases, CodeMart reserves the right to immediately suspend or permanently ban the account, dispute the chargeback with supporting evidence of code delivery and Terms acceptance, and pursue recovery of any associated losses including fees imposed on CodeMart by payment processors.
• Buyers who file chargebacks deemed fraudulent or in bad faith by CodeMart or the card network may have their accounts permanently suspended and may be reported to fraud prevention networks.

5. Fees

CodeMart charges a platform fee on each transaction, applied to both buyers and sellers. The current fee rates are displayed at checkout and on the seller dashboard. Fees are non-refundable except in cases of proven seller fraud. Payments are processed by Checkout.com. Payment processing fees are separate from CodeMart's platform fees.

6. Escrow & Payouts

Buyer payments are held in escrow for 14 days after purchase to allow time for dispute resolution. If no dispute is filed within 14 days, funds are automatically released to the seller's payout account. CodeMart reserves the right to delay or withhold payouts pending fraud review or an open dispute.

7. Refunds & Disputes

All sales are final once a presale code has been delivered. Refunds are only available if the code provided is proven to be invalid or non-functional at the time of the presale window. Buyers must open a dispute within 5 days of purchase through the Disputes section of their account — disputes raised after this window may not be eligible for a refund. CodeMart will review all disputes and may issue refunds at its sole discretion. Refunds, if issued, are returned to the original payment method. Buyers must use CodeMart's dispute system before contacting their bank or card issuer. Bypassing the dispute process and filing a chargeback directly constitutes a violation of these Terms and may result in account suspension.

8. Prohibited Conduct

• Creating fake or duplicate accounts
• Listing codes you do not own or have not obtained legally
• Manipulating ratings or reviews
• Using the Platform for money laundering or other illegal purposes
• Reverse engineering or scraping the Platform

9. Limitation of Liability

CodeMart is a marketplace platform and is not responsible for the actions of buyers or sellers. To the maximum extent permitted by law, CodeMart's liability to you for any claim arising out of your use of the Platform is limited to the amount of fees paid by you to CodeMart in the 30 days preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violations of these Terms. Upon termination, any pending payouts may be withheld pending fraud review for up to 90 days.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms. We will notify users of material changes via email.
